Like Kind Exchange Webinar on January 20, 2009

We thought that we would start 2009 off with a webinar on 1031 tax deferred exchanges. This 1031 tax deferred exchange webinar is good for those who have never completed an exchange and for those who would like a refresher course on the subject.

It is taught by one of the leading experts in the industry, Mr. William L. Exeter, who has been a senior executive in the 1031 exchange industry since 1986 and has lectured and written extensively on the subject.

Mr. Exeter will start with an introduction to the various tax-deferral and tax-exclusion strategies, including combining Section 1031 with Section 121. The discussions will focus on the requirements, structures, processes, strategies, and compliance issues necessary to successfully complete a 1031 exchange transaction.

What Does Like Kind Property Mean Exactly?

Well, the answer to this question depends on the type of property that we are talking about. It is relatively easy to answer and determine what is like kind property if we are talking about real estate, but it is not so easy if we are talking about personal property.

Asset Classes
The vast majority of tax deferred exchange transactions involve real estate. In fact, I would estimate that over 98% of all tax deferred exchanges are exchanges of real property, which are much easier to determine whether the real property sold is like-kind to the real property acquired. Personal property tax deferred exchanges get more complicated in terms of determining whether the properties are like-kind or not.

Like-Kind Property
The determination as to whether real estate is like kind to other real estate is relatively easy. Any kind of real estate is like kind to any other kind of real estate provided that the properties sold and the properties acquired are held for:
  • Rental (Income Production)
  • Investment (Appreciation or Growth)
  • Used in a trade or business

That's it. As long as the real property you are selling and the real property you are buying fall within these categories your properties will be considered like-kind property.

Determining whether personal property is like kind to other personal property gets much more complicated. Personal property must be broken down into its asset classes and the determination as to whether the properties are like kind are made by asset class and not as a whole.

We Are Celebrating our 5th Anniversary This Year

5th Anniversary of The Exeter Learning Institute
We launched The Exeter Learning Institute Blog back on June 23, 2004 in order to provide real estate investors with thoughtful and educational real estate information so that they could make better informed investment decisions. And, we have been blogging ever since.

The 1031 Exchange Institute
We have received so many positive comments from loyal followers over the years that we decided to launch another blog that was specific to 1031 exchange related matters, and was later expanded to include tax-deferred related matters.

The 1031 Exchange Institute was launched on November 14, 2006, which included information, blog posts, and our first discussion board. The 1031 Exchange Institute far exceeded our expectations in terms of visitors, discussions and posts.

We wanted something that was more interactive, though, so we decided to roll out a real estate focused Discussion Board with numerous real estate related Forums.

The Exeter Discussion Board
We launched The Exeter Discussion Board in August 2007. Discussion boards can be very tricky, and most never really take off. But, we were pleasantly surprised when The Exeter Discussion Board far exceeded our expectations. In fact, it just recently surpassed its 1,000th post and 300th registered user.
